8. Subscription Programme

Unless you cancel in accordance with these Terms, your subscription will automatically renew at the then-current rate at the same billing interval selected at checkout.

You will not receive an additional reminder before each renewal unless required by applicable law.

8.2 Recurring Billing Consent

At the time of enrolment, recurring billing terms—including:

8.3 How to Cancel

  • Suspend shipments until payment is received

Your continued enrolment constitutes reaffirmation of your authorisation to charge your payment method.

Nacivera may use automatic account updater services provided by card issuers.

8.5 Subscription Refunds

Subscription orders are not eligible for the 90-Day Satisfaction Guarantee.

Refunds may be considered only for:

  • Unopened items
  • Unused items

Additional conditions:

  • Return shipping is the customer's responsibility.
  • Shipping and handling fees are non-refundable.

9. Order Cancellations

One-time orders may only be cancelled before tracking information has been issued.

Once tracking has been provided, the order is considered in fulfilment or transit and cannot be cancelled.

Requirements:

  • A $2.00 administrative fee may apply

Requests made through:

  • Social media
  • Live chat
  • Chargeback disputes

will not be treated as valid cancellation notices.

10. Billing and Account Information

We reserve the right to refuse any order at our sole discretion, including orders involving:

  • Suspected fraud
  • Pricing errors
  • Resellers or distributors

You agree to provide current, complete, and accurate account information.

By providing a payment method, you:

11. Coupon and Discount Code Policy

12. 90-Day Satisfaction Guarantee

Nacivera offers a 90-Day Satisfaction Guarantee exclusively for customers who do not experience results after:

  • A minimum of 90 consecutive days
  • Daily and consistent use
  • Compliance with product instructions

Eligibility

  • First-time purchase of a specific product
  • One claim per product type per customer

Refund Terms

If eligibility is confirmed:

  • Refund equals purchase price minus a 15% processing and handling fee
  • Refund issued to original payment method
  • Shipping fees are non-refundable

Exclusions

13. Chargeback Policy

Once a chargeback is opened:

Filing a chargeback for an active subscription renewal without following cancellation procedures constitutes a breach of your subscription agreement.

14. Shipping and Customs

Products are shipped through third-party carriers.

Delivery

  • Title and risk of loss transfer upon delivery to the carrier.
  • Carrier delivery confirmation constitutes conclusive proof of delivery.

Nacivera Is Not Responsible For:

  • Carrier delays
  • Weather delays
  • Customs delays
  • Incorrect shipping information

International Orders

Customers are responsible for:

  • Customs duties
  • Import taxes
  • Local fees

Returned Orders

If returned due to:

  • Incorrect address
  • Refused customs payment

A refund may be issued minus a 15% processing and handling fee.

18. Dispute Resolution and Binding Arbitration

All disputes shall be resolved exclusively through final and binding individual arbitration, except as otherwise provided.

18.2 Pre-Arbitration Notice

Nacivera bears arbitration fees beyond amounts comparable to court filing fees, where required by AAA rules.

Each party bears its own attorneys' fees unless otherwise required by law.

18.5 Small Claims Exception

Either party may pursue claims in small claims court.

18.6 Equitable Relief

Nacivera may seek injunctive relief involving:

  • Intellectual property
  • Confidential information
  • Fraud
  • Website misuse causing irreparable harm

18.7 Opt-Out Right

Users may opt out within 30 days by sending certified written notice containing:

  • Address
  • Email
  • Clear statement of intent to opt out

19. Class Action Waiver

All disputes must be brought individually.

Users waive rights to:

  • Participate in class actions
  • Serve as class representatives
  • Consolidate claims with others

The arbitrator has no authority to conduct class proceedings.

20. Mass Action Waiver

No dispute may proceed as a mass action involving 25 or more similar arbitration demands coordinated by the same or affiliated counsel.

Claims will proceed in batches of no more than 200 claimants.

21. Jury Trial Waiver

If a dispute proceeds in court, both parties waive the right to a jury trial.

22. Limitation of Liability

To the maximum extent permitted by law, Nacivera shall not be liable for:

  • Punitive damages
  • Lost profits
  • Lost data
  • Loss of goodwill

Liability Cap

Nacivera's total liability is limited to the greater of:

  • Amount paid in the prior 12 months; or

This is the sole and exclusive remedy available.

23. Indemnification

You agree to defend, indemnify, and hold harmless Nacivera and its affiliates from claims arising out of:

24. Limitation on Time to File Claims

must be commenced within one (1) year after accrual or be permanently barred.
